Terms and Conditions of use of the website

 General Terms and Conditions 

The purpose of these Terms and Conditions is to regulate access and use of the website https://www.simonesw.com , (hereinafter, the “Web”), understood as any type of content, product and/or service that is available to visitors and customers of the Web (hereinafter “customers”). ”,  “visitors” and/or “consumer”).

The Website is owned by Simoné Sleepwear (hereinafter, “Simoné”) who reserves the right to modify, totally or partially alter at any time and without prior notice the content, presentation, functionality, design, structure, products and/or or the services that the Web may contain. In this sense, visitors acknowledge and accept that Simoné may at any time interrupt, deactivate, eliminate, modify or cancel any of the elements that make up the Web. Likewise, visitors declare that due to the possible modifications that Simoné may make to the Web, they should review the Terms and Conditions that are in force at the time of consultation.

The Web is aimed at people of legal age, therefore, Simoné  will not have any responsibility, whether present or future, direct or indirect, in the event of any eventuality due to non-compliance with this requirement. In this sense, to continue visiting the Web, the visitor declares to be of legal age and have the necessary capacity to abide by these Terms and Conditions and/or the other documents or conditions found on the Web.

The Web undertakes to make its best efforts to provide full and continuous access and use of the Web, however, it is not responsible for any failure or interruption on the Web when they are caused by cases not attributable to Simoné.

Simoné indicates as his domicile Calle Jirón Pedro Martinto, 114, district of Barranco, province and department of Lima, Republic of Peru for which the client declares to know that the jurisdiction is that of Lima, renouncing the jurisdiction of his domicile and submitting to the administrative or judicial authorities of Lima.

Specific Terms and Conditions

Transactions carried out on the Web are subject to these Terms and Conditions, as well as in a supplementary manner to current Peruvian legislation.

In this sense, the visitor acknowledges, and undertakes to know and accept these Terms and Conditions before proceeding to use the services of the Web or make any purchase. It is clearly established that any transaction made on the Web is understood to be carried out subject to these Terms and Conditions. That said, if any visitor does not agree with the provisions of these Terms and Conditions, they should not carry out any transaction on the Web.

Purchase Manual

The Web is a virtual platform through which Simoné  offers its products, exhibiting its characteristics. Through the Web, the Client may acquire any of the products and receive it at the address indicated by the Client. The website is designed so that the customer can choose and buy the different products displayed with their characteristics and prices.

To buy, the Client must only choose the products they want, add them to the cart and make the payment, filling in the requested information, under the scope of the Privacy Policy.

 In case the Client wishes to add a dedication or special message, or in the case of a gift, he may include the message in the “Additional Information” section.

 The Client must make the payment through the “Mercado Pago” platform, using any credit or debit card. Once the payment has been made and verified, the Client will receive a confirmation order in his email.

 Dispatch and Delivery of Products

The dispatch and delivery of the products purchased through the Web will be made within a period of two (2) to three (3) business days for Lima and within a period of three (3) to five (5) business days for provinces. The deadlines will be computed from the reception of the purchase confirmation in the Customer’s mail.

Shipments are made by Movilogistica SAC, identified with RUC No. 20606385782, an outsourced company contracted by Simoné in the case of Lima and by Olva Courier SAC in the case of provinces. In that sense, we do not control the safety or delivery times of the products.

Shipping prices are currently as follows:

Lima Center S/11.00 (San Miguel, San Isidro, Breña, Miraflores, Pueblo Libre, Surquillo, Magdalena, San Luis, Jesús María, San Borja, La Victoria, Barranco, Lince, Santiago de Surco and Cercado de Lima)

South Lima S/13.00 (Chorrillos, San Juan de Miraflores, Villa El Salvador and Villa Maria del Triunfo)

East Lima S/15.00 (San Juan de Lurigancho, Santa Anita, Rimac, Ate, El Agustino and La Molina)

North Lima S/18.00 (Puente Piedra, Ventanilla, Los Olivos, Comas, San Martin de Porres, Independencia, Callao, Bellavista and Carmen de La Legua).

For the other districts not mentioned in the list above and for provinces in general, the shipping price is S/25.00.

In case the Client wishes the Express shipping option (the same day or the next day) the price of the shipments amounts to the sum of S / 25.00 (Twenty-five and 00/100 Soles), only for the districts of Lima Centro, Lima South, East Lima and North Lima.

The customer will be able to pick up the purchased product from the tax address of Simoné, for which he must send a message to the phone number 933045205 and coordinate its pick-up.

The client declares that he is solely responsible for the contact information indicated for the dispatch and delivery of the products purchased through the Web. In this sense, Simoné is not responsible under any circumstances for any error in the supply of said information. That said, if the shipment cannot be delivered due to bad information provided by the Client, its delivery will be rescheduled, and the Client must assume the new shipping cost.

Cancellations, changes and returns

The customer may cancel his purchase within the day of making it and only in case the order has not been dispatched. For this, the Client must send a message to the number 933045205 to coordinate the cancellation. 

In the case of returns, the Customer may only make the return within two (2) days of receiving the product and only when the product does not reasonably conform to the terms of the offer or when it arrives in poor condition, broken or damaged. damage; or in the cases that the Consumer Protection Code indicates. To do this, you must communicate by text message to the number 933045205 and coordinate the return.

The Client may request a change within four (4) days of receiving the product and only in case the size is not correct or the garment has arrived in poor condition or has not arrived in perfect condition. The product may be changed in size or for another model of equal or greater price. If the price is higher, the Client must pay the difference. To coordinate the changes, the Client must contact by text message to the number 933045205 and coordinate the change.

For all the cases described above, the exchange or refund will only be made if the product has not been used, modified or altered and contains the labels with which it was received.

Products purchased on sale or promotions will not be subject to changes or returns.

Processing of Personal Data

Simoné informs the consumer that it will process their personal data provided on the Web, which includes (name, surnames, identity document, emails, user, access codes, address and telephone). The client declares to know that this data processing is necessary and has the purpose of executing the services in charge of Simoné, among which are included those of (i) invoice the customer, (ii) perform post-sale service; (iii) send you promotions and product offers; (iv) carry out commercial projections and (v) data analysis.
